Acceptance of Terms

By accessing or using PortraitPay AI, you agree to be bound by these terms.

Service Description

PortraitPay AI provides the following services:

• Upload project materials and organize creation records
• Cryptographic integrity records and verification status
• Storage and export of project materials, subject to the selected service configuration
• Project-package preparation for review, delivery, and dispute-related evidence

Eligibility

You must be at least 18 years old and not prohibited from using such services.

Portrait Rights

You have the following rights to your portraits:

• You are responsible for having the rights and permissions required for the materials you submit. PortraitPay records submitted materials; it does not grant, register, or determine copyright on your behalf.
• Ensure portraits don't infringe third-party rights
• Civil capacity to sign legal agreements
• If a public figure, obtained relevant authorization

Platform Notice

Records are stored with cryptographic integrity controls (SHA-256 hashes, signed manifests). The platform cannot guarantee that any record is completely resistant to tampering.

Licensing Notice

PortraitPay does not negotiate licenses, determine rights, distribute royalties, or provide legal advice. Users remain responsible for their contracts, permissions, and any rights required for their materials.

User Conduct

You must not engage in the following activities:

• Use others' portraits without consent
• Upload illegal or infringing content
• Manipulate platform records or systems
• Use bots or automated scripts
• Harass or threaten other users
• Violate any applicable laws

Account Deletion Process

You can delete your account through the following steps:

1. Log in and go to Settings
2. Click "Delete Account" button
3. Confirm deletion
4. Permanent deletion after 30-day cooling period

After deletion, all personal data will be permanently removed.

Disclaimer

The platform is not liable for any direct or indirect losses.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.

Arbitration Opt-Out

You may opt out of the arbitration requirement within 30 days of first accepting these Terms by sending a written notice to contact@portraitpayai.com with the subject line "Arbitration Opt-Out." If you opt out, the mandatory arbitration clause will not apply to you, and any disputes will be resolved in the courts specified in the Dispute Resolution section.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California, under its Comprehensive Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.

The exclusive venue for any action not subject to arbitration shall be the state and federal courts located in Los Angeles County, California. You and PortraitPay AI hereby consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these terms at any time.
